The management of BMC Gardens has lost its appeal lodged at the Juba High Court after it banned the venue from hosting night parties and wedding events.
The court banned the management of the venue in December 2023 following a complaint filed by prominent lawyer Kiir Chol Deng Acuil who accused the management of BMC Gardens of disturbing the peace of residents of Nyakuron South.
The appeal was lodged at the Juba High Court by BMC management in January 2024.
The Juba county court in December 2023 made a ruling prohibiting wedding ceremonies at the popular BMC hall after residents of Nyakuron South filed a case in June against Bol Mawut Deng the owner of BMC Gardens.
The Juba high court judge Mangiest Amusa Wajia concurred with the earlier ruling of the Juba County, Nyang Wol in December 2023 banning BMC Gardens from hosting wedding ceremonies and parties.
“Argument about license of the appellant garden hall are rejected because the attached order from the Mayor prohibits running and conducting discos and nightclubs within the town and BMC was among them,” said Amusa while issuing court ruling on Tuesday in Juba.
Amusa added that the Juba County Court judge did not err while making ruling in the case between Kiir Chol Deng Acuil and management of BMC Gardens.
“This court has found that the trial judge of the second class magistrate with powers of the first class judge has not erred in his decision according to the criminal trial process and weighing of the evidence. Therefore, this court has confirmed the appeal judgment,” he said.
