Machar’s Trial Adjourned as Court Awaits Prosecution Evidence

The Special Court on Monday postponed the trial of suspended First Vice President Dr. Riek Machar Teny and his seven co-accused until Wednesday to give the prosecution team time to present evidence.

The Special Court on Monday postponed the trial of suspended First Vice President Dr. Riek Machar Teny and his seven co-accused until Wednesday to give the prosecution team time to present evidence.

This decision followed the prosecution’s request for more time to assemble evidence.

Presiding Judge James Alala Deng said the court is set to rule on objections from both parties on Wednesday, 1st October 2025, when sessions resume.

“We agree with the request because each party is supposed to present evidence thoroughly; therefore, the session will be continued until Wednesday,” Deng said.

Advocate Ajo Ohisa, a member of the prosecution team, stated that they will present their arguments and supporting documentation, call witnesses, and bring evidence to court.

Presiding Judge Deng has also determined that the court has the authority and capability under national laws to adjudicate this high-profile case.

“Section 16 of the Code of Criminal Procedure Act 2008 provides for special courts, and specifically subsection 2 of the above allows the president of the Supreme Court to convene a special court presided over by a high court judge,” Deng said during Monday’s session.

“Or any other senior judge to be assisted by two assessors for the trial of tribal or sectional conflict and disputes involving capital offences.”

He stated that the Judiciary Act of 2008 permitted the establishment of a special court to address incidents within the constitutional framework.

Deng stated that the special court has the authority to adjudicate crimes related to the incidents in Nasir that occurred in March 2025.

The court also denied the request to lift the immunity of the First Vice President, stating that Machar does not possess constitutional immunity.

Machar and seven others face serious charges, including murder and terrorism, related to the March 2025 Nasir clashes that resulted in significant casualties.
